TERMS & CONDITIONS
  1. 1. Trojan Oils Pty Ltd ACN 601 061 492 (Trojan Oils) ensures that all personal information collected by it is:
    a. collected, used and stored securely and strictly in accordance with the National Privacy Principles in the Privacy Act 1988 (Cth);
    b. not used other than for the purpose for which it was collected; and
    c. accessible to the person to whom it relates for the purposes of ensuring that the information is accurate, complete and up to date.
  1. The Customer warrants to Trojan Oils that the information provided by it in this Credit Application is true, accurate and complete.
  1. The duly authorised representative of the Customer completing this Credit Application on behalf of the Customer, represents and warrants to Trojan Oils that the Customer has authorised that person to complete, sign and date this Credit Application, and that the information provided by the Customer’s representative on behalf of the Customer in this Credit Application Form is true, accurate and complete.
  1. The Customer irrevocably warrants to Trojan Oils that its duly authorised representative which completes, signs and dates this Credit Application Form has been provided with the necessary authority by the Customer to complete, sign, date and bind the Customer to this Credit Application and the Customer indemnifies Trojan Oils from and against any actual, contingent or consequential losses, damages or expenses which it suffers or incurs if the warranty provided by the Customer in this clause 4 is in any way, directly or indirectly, incorrect, erroneous or in any respect, false or misleading.
  1. The Customer acknowledges and agrees that Trojan Oils’ trading terms and conditions forming part of Trojan Oils’ Equipment Contract Application are accepted as the basis upon which any supply of cooking oil and goods will be made by Trojan Oils to the Customer. The person completing this Credit Application Form must sign and date Trojan Oils’ trading terms and conditions as this acknowledgement is a requirement, and forms part of this Credit Application.
  1. Trojan Oils may, pursuant to the Privacy Act, provide a credit reporting agency with personal information of the Customer, including but not limited to for the purposes of obtaining information in relation to the creditworthiness of the Customer, any credit defaults committed by the Customer, all loans applications made and all loans procured by the Customer and any other like credit information.
  1. The Customer agrees to pay back any credit or other financial benefit provided by Trojan Oils to the Customer no later than thirty (30) days from the date of the issued tax Invoice, or such other dated agreed in writing between Trojan Oils and the Customer from time to time.
  1. The Customer agrees that this Credit Application Form is a binding security agreement for the purposes of the Personal Property Securities Act 2009 (Cth) and the Customer and the Guarantor(s) authorise Trojan Oils to register its security interest or interests under this Credit Application on the Personal Property Securities Register pursuant to the Personal Property Securities Act 2009 (Cth).
  1. Costs of Recovery: The Customer shall pay the Supplier for all costs incurred by the Supplier (including costs for which the Supplier may be contingently liable) in any attempt to collect any monies owed by the Customer to the Supplier under this Agreement including debt collection agent costs, repossession costs, location search costs, process server costs and solicitor costs on a solicitor/client basis.
